In his time in private practice, and as a public defender, Ben Harwich has successfully defended thousands of people. 

Case Dismissed

Client charged with domestic battery. A motion to suppress evidence was successful and all incriminating evidence was thrown out by the Court. The prosecutor dismissed the case.

Case Dismissed

Client was charged with a DUI. The prosecutor delayed in turning over important evidence. As a result, the court did not allow necessary evidence to be introduced at trial. The prosecutor dismissed the case.

Client was charged with attempted murder and conspiracy to commit first degree murder. The client faced life in prison if convicted. After a 5 day jury trial the client was found not guilty and walked out of the courtroom with his freedom.

Client was charged with strangulation of his wife. The case proceeded to jury trial and the client was found not guilty.

Client was charged with two counts of felony DUI. The case was thrown out at preliminary hearing after arguing to the court that evidence was not sufficient to support the charges.

Client was charged with felony-theft from a vehicle salvage yard. The case proceeded to trial and the client was found not guilty.

Client was a juvenile charged with threatening her boyfriend with a switchblade knife. Police did not properly mirandize the client so the confession was not admissible in court. Without a confession the prosecutor was forced to dismiss the case.

Client was charged with possession of burglary tools. The case was thrown out at the preliminary hearing after the court agreed with the defense's argument that the alleged burglary tools were simply tools that are not used to commit burglary.

Client was charged with possessing methamphetamine with intent to deliver. The client did know there were drugs in the vehicle and presumed her boyfriend must have left them in the car. The prosecutor dismissed the case.

Client was a freshman in high school who participated in a ‘fight club’ where students would consent to fighting each other. The alleged victim lied about having agreed to participate and reported to police that he was attacked. Video interview footage revealed police concealed information. The case was dismissed and the Chief of Police apologized for the officer’s conduct.
